In this Agreement, "you" and "your" refers to you and the entity for which you have the authority to bind to this Agreement and "we" or "us" refers to Trust Earned Travel a d.b.a. for DomainNameSanity.com LP, an Arizona Limited Partnership. This Agreement explains our obligations to those individuals and/or entities that use your services and explains your obligations to us by displaying the TET Seal on your web site. You agree that all information provided to us is accurate and we may utilize and display such information or other publically available information about you at our web site, www.tet.org (“Site”), at other web sites we may develop, or in a public press release(s). You agree to provide the highest professional, ethical and courteous quality services to the traveling public through the implementation of this Code of Rules and Standards: 1: A TET Seal Holder shall never use deceptive practices and shall be guided by: truth, accuracy, honesty, fairness and integrity in its activities. * A TET Seal Holder shall obey all laws and regulations and shall avoid any conduct or activity which would cause unjust harm to others. * A TET Seal Holder shall not engage in any act or omission of a dishonest, deceitful or fraudulent nature in the conduct of business activities. * A TET Seal Holder shall conduct its/his/her dealings in a civil, courteous and professional manner. 2: A TET Seal Holder shall exercise truth, honesty, integrity and fair dealings with customers. * A TET Seal Holder shall provide complete, accurate and informative materials, agreements, documents, information (print, electronic media, television, radio or otherwise) to its customers and/or to consumers. Informative materials, agreements, documents, information (print, electronic media, television, radio or otherwise) produced and/or utilized by a TET Seal Holder shall not contain false, misleading or incomplete information. * When a TET Seal Holder utilizes marketing materials and agreements with its customers (print, electronic media, television, radio or otherwise), it shall contain sufficient information to enable the customer to make an informed purchasing decision and which are clear and understandable. * A TET Seal Holder provide communications and information to its customers in a prompt and timely manner. 3: A TET Seal Holder's relationship with its customers. * A TET Seal Holder will promptly respond to any customer complaints. * A TET Seal Holder will issue agreed upon refunds in a timely manner. * A TET Seal Holder will treat every client transaction confidentially and not disclose any information without permission of the customer, unless required by law. * A TET Seal Holder agrees to work diligently to fairly resolve any complaint or dispute with a customer. Participation fees The cost and duration of the license fee is specified on our Site at the time you apply for and renew the Trust Earned Travel Seal. If at any time within 90 days of your first being approved to become a TET Seal Holder, you are dissatisfied for any reason, you can remove your TET Seal and request a full refund. Upon such request during this initial 90 days and upon our reviewing your web site and seeing that the Trust Earned Travel Seal has been removed from your web site, we’ll issue a full refund of the amount paid. There is no obligation to remain a TET Seal Holder or pay the renewal fee if you are not satisfied. All you need do is just remove your TET Seal from your web site at any time and inform us you do not wish to renew. After the initial 90 day period, we will issue you a pro-rated refund upon request provided the Trust Earned Travel Seal has been removed from your web site. TET reserves the right at any time and in its sole discretion to request that you remove all links or any particular link to our Site from your web site. You agree to immediately remove the specific or all links to our Site upon such request. TET also reserves the right to amend this Agreement and its linking policy at any time. By continuing to link to our Site, you agree to be bound to and abide by these terms and conditions. From time to time, TET may link to web sites that we determine may be of interest to our visitors or have paid us to place such links or advertisements. We are not responsible for the content of any linked web site, any link(s) contained in any linked web site, or any changes or updates to the information contained in such web sites. Access to any other web sites linked from this Site is at your own risk as we assume no responsibility for third-party web sites and such link does not imply TET’s endorsement of either the site, the person or entity operating the site, or any products or services of that person or entity. For example, we do not vouch for the accuracy or reliability of the information on third-party web sites. We assume no responsibility for the content of or services offered by linked third party sites, and make no representations regarding the accuracy of materials on third party Web sites. Violations and Additional Terms TET reserves the right to seek all remedies available at law and in equity for violations of this Agreement, including suspending or blocking your access to our Site. No Waiver No delay or failure by TET to enforce any portion of this Agreement shall constitute a waiver of any of our rights under this Agreement. Neither the receipt of any funds by TET nor the reliance of any person on our actions shall be deemed to constitute a waiver of any part of this Agreement. Only a specific, written waiver signed by an authorized representative of TET shall have any legal effect. Termination This agreement may be terminated by either party, at any time, by written or e-mail notification to the other party. Severability If any clause or provision set forth in this Agreement is determined to be illegal, invalid or unenforceable under present or future law, the clause or provision shall be deemed to be deleted without affecting the enforceability of all remaining clauses or provisions. Governing Law and Jurisdiction This Agreement and any disputes arising under or related to this Agreement and/or the Privacy Policy or to our Site will be governed by U.S. federal law and the laws of the State of Arizona, without reference to its conflict of law principles. Any such dispute shall be resolved exclusively in the state or federal courts in Arizona. You agree to submit to the personal jurisdiction and venue of the courts of the State of Arizona for any legal proceeding involving our Site, regardless of who initiated the proceeding. Changes to this Agreement TET reserves the right, in its sole discretion, to modify, alter, or otherwise change this Agreement at any time. We will provide notice of such change on the our Site. Please review the terms of this Agreement periodically for changes. Your continued use of our Site constitutes your acceptance of and agreement to be bound by these changes without limitation, qualification or change. If at any time you determine that you do not accept these changes, you must stop using our Site. I agree to the Seal Holder Terms of Agreement.
